General Terms and Conditions

1. Definitions

The following definitions apply throughout these general terms and conditions of use. Unless otherwise required by the context, terms and definitions in the singular include the plural.

  • "Application": means the mobile application operated by Marcel available on iOS or Android.
  • "Call Centre": refers to the telephone call centre operated by Marcel which allows Bookings to be made.
  • " General Terms and Conditions ": refers to the present general terms and conditions of use of the Marcel Service, concluded between Marcel and the Customer.
  • "Driver": refers to a professional in the field of passenger transport operating a chauffeur-driven vehicle, who uses the Marcel Service to be put in contact with Customers, with a view to providing transport services for Customers.
  • "Customer": refers to any natural person who has an Account.
  • " Company Customer ": refers to a legal entity that has entered into a specific contract with Marcel to enable its employees to benefit from the Marcel Service.
  • "Promotional Code": refers to a promotional code issued by Marcel or by a third party on Marcel's authorisation.
  • "Account": refers to the Customer's dedicated and individualised digital space, accessible via the Website or the Application using a login and password.
  • "User Content": refers to any data or information, other than (i) personal data within the meaning of legislation relating to the protection of personal data or (ii) protected intellectual property, communicated by the Driver to Marcel by any means on the Website or the Application.
  • " Journey ": refers to a transport service provided by a Driver to a Customer via the Marcel Service.
  • "Specific Request": refers to any specific request made by a Customer in the context of a Booking, such as the presence of a pet.
    "Cancellation Fee": refers to the cancellation or no-show fee payable by the Customer as specified in the price list in the Appendix.
  • "Waiting Charges": refers to the waiting charges payable by the Customer if the Customer arrives more than 5 minutes (excluding airports) after a Booking has been made. The Waiting Charges are specified in the price list in the Appendix.
  • "Marcel": refers to the simplified joint stock company Marcel, with capital of 8,606,350 euros, registered in the Paris Trade and Companies Register under number 817 646 375 and whose registered office is located at 21 rue d'Uzès, 75002 Paris.
  • "Option": refers to a paying option taken out by the Customer with a Partner using the Marcel Service, such as a welcome sign.
  • " Booking ": refers to any request for a transport service made by a Customer via the Marcel Service.
  • " Marcel Service ": refers to the contact platform and reservation centre within the meaning of article L.3142-1 of the French Transport Code, made available by Marcel. The Marcel Service is accessible via the Application, the Call Centre or the Website.
  • " Website ": refers to the internet site operated by Marcel at the address www.marcel.cab as well as all of its sub-domains.
  • "Territory": refers to the territory(ies) in which the Marcel Service is made available, as indicated in the Application.

2. Purpose and scope of the General Terms and Conditions

The General Terms and Conditions apply to the relationship between Marcel and the Customer. Their purpose is to define the general terms and conditions of access to and use of the Marcel Service by the Customer, and to define the rights and obligations of Marcel and the Customer in relation to such use.

The General Terms and Conditions do not apply to the relationship between Marcel and the Driver.

In accordance with the regulations of the French Transport Code and the status of a central booking office, the Marcel Service is a service for putting drivers or transport companies in contact with passengers. Marcel is not a party to the transport operation carried out by the Driver for the benefit of the Customer, nor to the transport contract concluded between the Driver and the Customer in this context.

 

3. Registration, acceptance and modification of the General Terms and Conditions

3.1 Registration for the Marcel Service 

Any natural person over the age of 18 may register to benefit from the Marcel Service, by creating an Account directly via the Application or the Website, or via the Call Centre or a Company Customer.

In any event, any natural person wishing to register must provide the information required to create their Account and in particular their first name, surname, email address, phone number and a means of payment.

3.2 Acceptance of the General Terms and Conditions

During the Account creation process, any person wishing to register undertakes to read the General Terms and Conditions and must indicate their consent by ticking the box "I have read and accept the General Terms and Conditions" on the Application or "I accept the Terms and Conditions" on the Website.

When the Account is created by the Call Centre, the General Terms and Conditions are deemed to have been accepted as soon as the creation of the Account is finalised.

Upon acceptance, the Customer receives an e-mail confirming the creation of his Account at the address he provided when registering.

Use of the Marcel Service is reserved for Users who have accepted the General Terms and Conditions.

3.3 Evolution of the Marcel Service and modification of the General Terms and Conditions 

In order to improve its operation and quality, Marcel may change the characteristics and functionalities of the Marcel Service.

Marcel may unilaterally modify the General Terms and Conditions as long as this does not result in an increase in price for the Customer or an alteration in the quality of the Marcel Service and as long as the essential characteristics of the Marcel Service are not modified. These modifications may, for example, relate to the technical development of the Marcel Service.

Marcel will inform the Customer of any changes made to the General Terms and Conditions in good time and by any means, at least 7 days before they come into force. The latest version of the General Terms and Conditions is available at the following address: www.marcel.cab/general-terms-and-conditions. If the Customer does not object within this period, the changes will be deemed to have been read and accepted. In the event of objection or refusal, the General Terms and Conditions shall be terminated immediately and the Customer shall cease to use the Marcel Service.

 

4. Account access, use and security

4.1 Customer responsibility 

Unless there is a security failure attributable to Marcel or a case of force majeure, the Customer is responsible for the access, use and security of his Account. In particular, the Customer must ensure the confidentiality of his connection data and undertakes to implement all measures to ensure their security and confidentiality.

Customers are free to change their password at any time, in particular to ensure the security of their Account.

4.2 Obligation to notify

If the Customer has reason to believe that his connection data has been lost, stolen, misappropriated or compromised in any way, or in the event of unauthorised use of his Account, the Customer must immediately notify Marcel using one of the means of contact referred to in article 16.

In the absence of such notification, any Booking or more generally any use of the Marcel Account or Service are deemed to have been made by the Customer.

In the event of a potential or proven threat to the security or confidentiality of the Account, the Customer authorises Marcel to take all appropriate measures to prevent any unauthorised access to the Account, and in particular to reset the Customer's password and identifier.

 

5. How the Marcel Service works

5.1 Booking 

After logging into their Account, Customers can make a Booking via the Application, the Website or the Call Centre.

In order to make a Booking, the Customer must choose whether they wish an immediate or advance Booking (for a departure in more than 30 minutes in Île de France, 1 hour in Nice and Lyon and 2 hours for other French cities). The Customer must provide all the information required, in particular the pick-up location (as well as the date and time if the Booking has been made in advance), the destination and the category of vehicle required. Otherwise, the Booking cannot be processed by Marcel.

The Customer may also make a Specific Request or subscribe to an Option at the time of Booking, which Marcel will forward to the Driver, who is free to accept or refuse it.

As soon as the request is confirmed and the Booking is received on the basis of the information provided by the Customer, Marcel will send the Customer a price proposal for the journey requested (which the Customer is free to accept or refuse) and, in the case of an immediate booking, an estimate of the waiting time.

5.2 Booking confirmation 

By clicking on the corresponding function on the Website or the Application, or by definitively validating their Booking by phone with the Call Centre, the Customer's Booking is confirmed, provided that the means of payment entered by the Customer or the Company Customer is available and/or functioning.

Upon confirmation, or 20 minutes before the pick-up time if the Booking was made in advance, the Customer will receive a confirmation by text message and/or email confirming that a Driver is approaching (or that the Driver will arrive on the date or at the time agreed if the Booking was made in advance), as well as the Driver's contact details.

The Customer undertakes to arrive at the location and, in the case of an Advance Booking, at the time agreed.

For journeys in the Île-de-France, Nice and Lyons regions

If the Customer does not arrive within 5 minutes (and 20 minutes at airports) of the Driver's arrival as evidenced by the sending of the confirmation text message or the time agreed in the case of an Advance Booking, a Waiting Charge will be payable, in accordance with the rates shown in the Appendix.

If the waiting time (excluding airports) exceeds 15 minutes from the arrival of the Driver, the Booking will be deemed to have been cancelled and a Cancellation Fee will be payable, unless the Customer and the Driver agree to extend the waiting time, in which case an additional Waiting Charge will be payable.

For other towns in France

The waiting time is 10 minutes (and 10 minutes at airports). If the Customer does not arrive within 10 minutes of the start time of the journey, the journey will be considered cancelled.

5.3 Cancelation of a Booking 

The Customer may cancel a Booking free of charge via the Application, the Website or by contacting the Call Centre in the following cases:

For journeys in Île-de-France, Nice and Lyon regions

  • the cancellation occurs less than 5 minutes (excluding airports) after the Booking; or
  • the cancellation occurs at least one hour before the pick-up time, if the Booking was made in advance.

For other French cities

  • the cancellation must be made at least two hours before the pick-up time, if the Booking was made in advance.

All cancellations outside these two cases will incur Cancellation Fees, in accordance with the price list in the Appendix.

5.4 End of the journey 

At the end of the Journey, Marcel will send the Customer by email an invoice issued in the name and on behalf of the Driver detailing the main characteristics of the Journey (and in particular, the date, place of pick-up, place of arrival and means of payment used) as well as its price (including, where applicable, any Waiting Charges, reductions or other charges invoiced in accordance with the General Terms and Conditions).

5.5 Specific features of stations and airport pick-ups 

The Customer may include in the details of a Booking the estimated time of arrival of a train or plane, in order to enable the Driver to pick up the Customer in the best possible conditions. This service only works if the data is accurate and has been entered in the boxes provided for this purpose on the Application or on the Website, or communicated via the Call Centre.

In this situation, Marcel will transmit the information to the Driver and will adapt the pick-up time agreed between the Driver and the Customer according to the scheduled arrival time of the train or flight. The Customer may also ask the Driver to provide a welcome sign service at the exit of a station or airport, through Marcel.

These two services are Specific Requests and are subject to the General Terms and Conditions governing them.

 

6. Rates

6.1 Criteria for setting the price of a Journey

The rate charged for each Booking is set by Marcel for each Journey and is made up of :

  1. a service charge of €1.50 for each Journey (booked in advance or immediately)
  2. the price of the Journey, consisting of a variable sum, the amount of which varies for each journey according to the following parameters:
  • distance to be covered ;
  • anticipated duration of the Journey (with regard to the time slot, the route to be taken and the traffic forecast provided by Marcel's tool);
  • category of vehicle chosen ;
  • the existence and nature of an Option (for example, a welcome with a sign); and
  • the date and time of the Booking.

In any event, the total price of the Journey is fixed prior to the Journey. It may vary during the course of the Journey in accordance with the stipulations below.

6.2 Paying Options

  • Personalised Welcome sign: €10 chargeable option at the airport for Berline, Electric/Hybrid and Van ranges.
  • Baby seat/booster seat option: option subject to a charge of €10 per baby seat/booster seat. If you do not have a child seat during your journey, the driver may refuse to pick you up. The journey may be cancelled and a cancellation fee will be charged to compensate the driver.
  • Medium-sized dogs option: paying option of €20 / dog
To take advantage of Marcel's paying options, you must make your request 24 hours before the start of your journey by phone on +33 (0)1 70 95 14 15. Our customer service team is available 24/7. Any request made via another channel or after this time will not be taken into account.

6.3 Modification of the price of a Booking once the Journey has been completed

The price of a Journey may be different from the price initially quoted for a Booking when the Customer changes the characteristics of a Booking before the pick-up time or of a Journey during the pick-up time, for example in the following cases:

  • the Customer makes the Driver wait for more than 5 minutes (excluding airports) and a Waiting Charge is payable in accordance with the conditions stipulated in article 5.2 and the pricing conditions in the Appendix;
  • the Customer adds an intermediate stop to the Journey;
  • the Customer changes the destination initially chosen.

If the Customer changes a journey booked in advance less than one hour before the scheduled departure time, cancellation charges will automatically be applied.

6.4 Penalties for damage

In the event of damage to the Partner's vehicle attributable to the Customer, Marcel's payment service provider may deduct on behalf of the Partner a flat-rate amount of €100 (inclusive of tax) in the event of soiling or an amount corresponding to the costs of repairing or restoring the vehicle on the basis of supporting documents presented by the Partner (for example, cleaning costs).

In such a situation, Marcel will ask the Customer to provide explanations. If there is no response to Marcel's request, the Customer will be debited for the corresponding costs.

 

7. Payment

7.1 How payment works

Payment for the Journeys is made to Marcel's payment service provider using the Customer's means of payment or that provided by a Company Customer.

The price of the Booking is subject to bank authorisation at the time of the Booking. The Customer or the Company Customer will be charged by the means of payment provided at the time of the Booking. If the Booking is made more than 4 days before the planned date of the Booking, Marcel's payment service provider will carry out a new bank authorisation on the Customer's or Company Customer's means of payment 4 days before the planned date of the Booking.

If the bank authorisation is refused by the Customer's or Company Customer's bank, the Booking will be cancelled and the Customer will be informed.

Thanks to the technological solution developed by Adyen, a payment service provider, the price of the Journey is split between the Driver and Marcel once it has been completed.

The Customer does not make any payment directly to the Driver, with the exception of any tips left to the Customer's discretion or any use of the Marcel Service under a contract signed with a Company Customer.

7.2 Payment data security and fraud prevention

Marcel's payment service provider stores and processes the Customer's or Company Customer's payment data securely, in particular using encryption processes.

In order to guarantee the security of transactions, Marcel's payment service provider also uses anti-fraud mechanisms. Thus, in order to validate the addition of a means of payment, the Customer or the Company Customer may be asked to take steps to guarantee the security of transactions, for example by following the instructions on a 3D Secure page set up by their banking establishment.

If the verification or authentication mechanism fails, the payment method may be refused and a Booking may not be validated.

In addition, in accordance with article 12, Marcel may suspend the Customer's Account in the event of fraudulent use or suspected fraudulent use of a means of payment identified by an anti-fraud mechanism.

 

8. Discounts

Promotional Codes or credits issued by Marcel may be deducted from the price of a Journey.

The Promotional code is directly deducted from the price of a Journey once it has been entered on the Application or the Website.

These discounts are subject to specific restrictions of use which are specified and freely modifiable by Marcel. In particular, the Customer understands and accepts that the Promotional codes and credits provided by Marcel :

  • may only be used in accordance with the specific conditions established for each of them ;
  • may expire before the Customer is able to use them;
  • are not redeemable for cash; and
  • may be cancelled at any time, reduced or refused, in particular if the use of the code or credit is erroneous, fraudulent, unlawful or contrary to the rules applicable to the said code or credit.

 

9. Commitments by Marcel

9.1 Availability of the Marcel Service

Marcel undertakes to make the Marcel Service available to the Customer in the Territory and to make its best efforts to ensure its accessibility and proper operation.

In this respect, Marcel undertakes to ensure that the Marcel Service is accessible 24/7, except in cases of force majeure or unforeseeable and insurmountable behaviour by a third party, and subject to any breakdowns and maintenance and updating operations necessary for the proper functioning of the Marcel Service. Given the specific characteristics of the Internet and telecommunications networks, Marcel cannot guarantee permanent availability of the Marcel Service.

In addition, Marcel may at any time suspend certain functions of the Marcel Service with a view to improving them or remove certain functions with a view to replacing them.

In the event of a malfunction or anomaly disrupting the proper functioning of the Marcel Service, Marcel undertakes to use its best efforts to restore the situation.

9.2 Connection with a Driver

In accordance with its status as a central booking office, Marcel undertakes to forward the Customer's Booking and the associated price proposal to the nearest Drivers. Thanks to the technological solution developed by Marcel, Marcel makes every effort to find an available Driver close to the Customer and thus to put the Customer in touch with the Driver.

However, as Marcel is not a party to the transport contract concluded between the Driver and the Customer, and as each Driver is free to accept or refuse a Booking and the associated proposed fare, Marcel cannot guarantee that a vehicle will always be available and that the Customer's Booking will result in a Journey, just as the estimated waiting time is provided for information purposes only, on the basis of the traffic prediction tool used by Marcel.

In addition, Marcel does not guarantee that a Driver will accept to pick up the Customer even if the Booking has been confirmed by the Driver, in particular, but not only, if the Customer does not comply with the General Terms and Conditions (for example, if the Customer is in a state of intoxication, if the Customer presents a danger to the safety of the Driver or third parties or if the Customer's luggage is too large for the Driver's vehicle).

9.3 Account security

Marcel undertakes to ensure the security, confidentiality and integrity of the Marcel Service and the Account.

 

10. Marcel's liability

In any event, Marcel's liability is limited to its status as a central booking office and operator of a platform for bringing people together.

Marcel may under no circumstances be held liable for causes beyond its control, in particular in the following cases :

  • the Booking made by the Customer has not resulted in a Journey due to a lack of available drivers;
  • a Specific Request or Option sent to the Driver has not been honoured by the latter;
  • the Customer has breached a provision of the General Terms and Conditions or has not followed the instructions on the Website or the Application;
  • the Customer has not complied with the transport contract concluded with the Driver after having been put in contact with the latter;
  • in the event of an unforeseeable and insurmountable act by a third party and in particular in the event that the Driver behaves in an unforeseeable manner or does not comply with the essential stipulations of the general terms and conditions of partnership binding him/her to Marcel ;
  • in the event of force majeure.

In addition, Marcel may under no circumstances be held liable for the consequences of fraudulent use of the Customer's identifiers, except in the event of a technical failure attributable to Marcel, or for any prejudice suffered by the Customer as a result of providing incorrect personal information in the Account.

In any event, Marcel's liability is limited to direct damages and may not exceed the amount of the price of the Journey directly borne by the Customer or Company Customer.

In the event of poor performance of the transport contract between the Driver and the Customer, the Customer may contact Marcel by one of the means referred to in article 16, giving priority to the corresponding function on the Application allowing a request for assistance to be made directly in relation to a completed Journey.

 

11. Commitments by the Customer;

  • to comply with the laws and regulations in force and not to undermine public order, public decency or the rights of third parties, and not to infringe any legislative or regulatory provision ;
  • comply, in particular, with the provisions of the Highway Code (for example, the obligation to use a child seat if travelling with passengers under the age of 10);
  • be of legal age and have the capacity to enter into a contract with Marcel;
  • provide Marcel with all the information necessary for the proper performance of the Marcel Service;
  • use the Marcel Service in accordance with its purpose and object, and make fair use of it;
  • to provide truthful, accurate and error-free information when creating the Account, and to keep this information up to date, in particular as regards his title and identity, and to use a means of payment in his name;
  • to make strictly personal use of his/her Account and not to create false accounts or under a false identity, and not to transfer or assign the Account to a third party;
  • not to duplicate, sell, transfer or make available to the public any Promotional codes or credits provided by Marcel;
  • inform Marcel in the event of a complication of any kind with a Driver or another Customer;
  • arrive at the pick-up location agreed with the Driver via Marcel, unless he/she exposes him/herself to Waiting Charges or Cancellation Fees;
  • to behave appropriately, politely and respectfully towards the Driver and to avoid any behaviour which could jeopardise his own safety or that of the Driver and/or third parties;
  • not to damage the Driver's vehicle, subject to having to reimburse any damage caused.

The Customer understands and accepts that it is strictly forbidden :

  • any behaviour likely to interrupt, suspend, slow down or prevent the continuity of the Marcel Service;
  • any intrusion or attempted intrusion into Marcel's computer systems;
  • any action likely to impose a disproportionate burden on Marcel's digital infrastructures;
  • any breach of security and authentication measures;
  • any act likely to infringe Marcel's financial, commercial or moral rights and interests;
  • any copying and/or misappropriation of the Website, the Application and/or Marcel's digital infrastructure;
  • more generally, any practice diverting the Marcel Service for purposes other than those for which it was designed.

12. Suspension of access to the Marcel Service

The Customer's access to the Marcel Service may be suspended in the following cases;

  • The Customer, or one of the passengers accompanying the Customer during a Journey, does not comply with one of the stipulations of the General Terms and Conditions.
  • The means of payment entered by the Customer or the Company Customer is not supplied or does not work.
  • The Customer, or one of the passengers accompanying the Customer during a Journey, behaves inappropriately, violently or improperly towards a Driver or an employee or service provider of Marcel.
  • The Customer is suspected of using the Marcel Service fraudulently, for example by using a means of payment which is not his/her own.

In one of these situations, and following an adversarial investigation phase carried out by Marcel by any means (for example, by phone), access to the Service may be restored, or, as the case may be, the General Terms and Conditions may be terminated, depending on the results of the investigation.

 

13. Duration and termination of the General Terms and Conditions

13.1 Duration 

The General Terms and Conditions are valid for an indefinite period from the date of their acceptance by the Customer.

13.2 Cancellation 

The use of the Marcel Service does not include any long-term commitment for the Customer, who is free to terminate the General Terms and Conditions, to no longer use the Marcel Service and/or to request the deletion of his Account at any time and without prior notice, provided that he has fulfilled his current obligations, and in particular that he has paid all sums due for the use of the Marcel Service and for the Journeys.

Marcel may terminate the General Terms and Conditions and cease to allow the Customer to use the Marcel Service in the cases previously mentioned in article 12 and after an adversarial phase.

Termination of the General Terms and Conditions shall result in the interruption of access to the Account and to the Marcel Service.

13.3 Cancellation procedure 

The Customer may cancel the General Terms and Conditions by sending an email to contact@marcel.cab.

Marcel may cancel the General Terms and Conditions by sending an email to the contact address given by the Customer in his Account.

 

14. Intellectual property and user content

14.1. Marcel's intellectual property

The Marcel Service, the Application, the Website and each of the elements that make them up, including but not limited to software, structures, infrastructures, databases and content of any kind (texts, images, visuals, logos, brands, etc.) used by Marcel are protected by all intellectual property rights in force.

The Customer acknowledges and agrees that the Marcel Service, the Application and the Website, and all the elements of which they are composed, including all associated intellectual property rights, are the exclusive property of Marcel.

Any reproduction or representation, in whole or in part, of the Marcel Service, the Application, the Website, or of each of the elements of which they are composed, is prohibited without the authorisation of Marcel. The General Terms and Conditions do not transfer any intellectual property rights to the Customer or to a third party.

Accordingly, the Customer agrees not to use, reproduce, adapt, modify, create derivative works from, distribute, license, sell, transfer, publicly display, transmit, broadcast or in any other way exploit the Marcel Service, the Application, the Website and all of the elements of which they are composed, without the prior written consent of Marcel.

14.2. User Content

The Customer grants Marcel the right to re-use the User Content in particular in order to :

  • publish them on the Website and/or the Application ;
  • modify or adapt them;
  • incorporate them in advertisements, communication media or any other documents;
  • create derivative content, distribute it and allow third parties to re-use it.

This right is granted for as long as the General Terms and Conditions are in force and for the entire world.

14.3. Hypertext links

The Website and/or the Application may contain links to third party websites. The linked websites are not under the control of Marcel, who is not responsible for the content of these linked websites.

 

15. Personal data

Marcel attaches great importance to Customers' personal data and to compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD).

16. Information about your geographical location

Marcel collects information relating to your geographical position when you use our services, as this data enables us to offer features such as seeing which drivers are available around me and finding out how long I have to wait before being picked up.

Your geographical position can be determined with varying degrees of accuracy using elements such as :

  • GPS
  • IP address
  • Your device's sensor data

Marcel provides the Customer with a support service to answer questions and provide assistance in the event of difficulties. For any question or request for information concerning the Marcel Service, the Customer may contact Marcel in the following manner:

 

18. Other

In the event that one of the clauses of the General Terms and Conditions is declared null and void by a change in legislation or regulations or by a court decision, this shall not affect the validity of the other clauses of the General Terms and Conditions, unless the clause declared null and void is essential in nature, modifies the interdependence of certain contractual stipulations or modifies the general structure of the General Terms and Conditions.

Failure by Marcel or the Customer to exercise their rights under the General Terms and Conditions does not constitute a waiver of such rights.

The Customer accepts the use of text messages and electronic messaging to use the Marcel Service. The Customer expressly acknowledges that the presence of an identification code validly identifies the author of a document or message and establishes the authenticity of the document or message, that an electronic document containing an authentication code is equivalent to a written document signed by the issuer and that Marcel and the Customer may rely on the printing of an electronic message on paper.

In the event that these general terms and conditions are drafted in several languages or translated, only the French version shall be deemed authentic.

 

19. Applicable law - Mediation - Competent jurisdiction

19.1. Applicable law

The General Terms and Conditions are governed by and construed in accordance with French law.

19.2. Médiation 

In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, it is possible to have recourse to the services of a mediator to try to find a favourable outcome to a dispute which has not been settled following a prior approach by a Customer to Marcel. The Customer is free to accept or refuse recourse to mediation, and in the event of recourse to mediation, Marcel or the Customer are free to accept or refuse the solution proposed by the mediator.

19.3. Jurisdiction

Pursuant to Article R. 631-3 of the French Consumer Code, the Customer may, in addition to one of the courts with territorial jurisdiction under the French Code of Civil Procedure, choose to bring the matter before the court for the place where the Customer resided when the contract was concluded or when the harmful event occurred.
